End User License Agreement (EULA)

This End User License Agreement ("Agreement") is a legal contract between you ("Licensee" or "you") and Pedro Miralles, based in Dubai, United Arab Emirates ("Licensor", "we", "us"), governing your use of the ArtboardKit Photoshop plugin (the "Software").

By installing, copying, or using the Software, you agree to be bound by the terms of this Agreement. If you do not agree, do not install or use the Software.

1. License Grant

We grant you a perpetual, non-exclusive, non-transferable, worldwide license to install and use the Software, subject to the terms of this Agreement.

You may:

• Install and use the Software on multiple devices owned or controlled by you (the licensed user)
• Use the Software for personal and commercial design work
• Use any artwork, exports, or output created using the Software without restriction

2. Restrictions

You may not:

• Resell, sublicense, rent, lease, distribute, or otherwise transfer the Software or your license to any third party
• Share your license key, download link, or any portion of the Software with anyone else
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Software, except to the extent expressly permitted by applicable law
• Modify, adapt, translate, or create derivative works based on the Software
• Remove, obscure, or alter any copyright, trademark, or other proprietary notices in the Software
• Use the Software to develop a competing product
• Use the Software for any unlawful purpose

3. Intellectual Property

The Software is licensed, not sold. All rights, title, and interest in and to the Software, including all copyrights, trademarks, and other intellectual property rights, remain with Pedro Miralles. No rights are granted to you beyond those expressly stated in this Agreement.

4. Updates

We may, at our discretion, release updates, patches, or new versions of the Software. Such updates may be provided free of charge or offered as paid upgrades. We are under no obligation to provide updates.

When delivered through the Adobe Creative Cloud Marketplace, updates are managed automatically by Adobe Creative Cloud Desktop.

5. Support

Support is provided on a best-effort basis via the contact channels listed on https://artboardkit.co. We do not guarantee response times or resolution of any particular issue.

6. Third-Party Software

The Software is designed to operate within Adobe Photoshop, which is a separate product owned by Adobe Inc. and licensed under separate terms. You are responsible for complying with Adobe's terms applicable to your use of Photoshop. This Agreement does not grant you any rights in Adobe products.

7. Refunds

All sales are final. We do not offer refunds, partial refunds, or exchanges, except where required by applicable law.

Before purchasing, you are encouraged to review the Software's features and demos available at https://artboardkit.co to ensure it meets your needs.

For purchases made through the Adobe Creative Cloud Marketplace, refund handling is governed by Adobe's and FastSpring's policies, which may grant rights beyond those described here.

8. Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE, UNINTERRUPTED, OR COMPATIBLE WITH ALL VERSIONS OF ADOBE PHOTOSHOP OR ALL OPERATING SYSTEM CONFIGURATIONS.

YOU USE THE SOFTWARE AT YOUR OWN RISK. ALWAYS WORK ON COPIES OF YOUR FILES AND MAINTAIN BACKUPS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PEDRO MIRALLES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR DESIGN WORK, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF (OR INABILITY TO USE) THE SOFTWARE.

OUR TOTAL CUMULATIVE LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE LICENSE.

NOTHING IN THIS AGREEMENT EXCLUDES OR LIMITS LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW (INCLUDING, FOR EU CONSUMERS, MANDATORY STATUTORY RIGHTS).

10. Termination

This Agreement is effective until terminated.

We may terminate this Agreement immediately, without notice, if you breach any of its terms. Upon termination, you must cease all use of the Software and delete all copies in your possession.

You may terminate this Agreement at any time by uninstalling and deleting the Software.

Sections 2, 3, 7, 8, 9, and 11 survive termination.

11. Governing Law

This Agreement is governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law principles.

Any dispute arising out of or related to this Agreement shall be resolved in the competent courts of Dubai, UAE.

If you are a consumer resident in the European Union, you may also be entitled to bring proceedings in the courts of your country of residence under mandatory local consumer protection laws.

12. Entire Agreement

This Agreement, together with our Privacy Policy at https://artboardkit.co/privacy, constitutes the entire agreement between you and us regarding the Software. It supersedes all prior agreements or communications.

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

13. Changes

We may modify this Agreement from time to time. The "Last updated" date at the top reflects the most recent revision. Continued use of the Software after changes constitutes acceptance of the revised Agreement.
